
Terms of Service (TOS)
Please read these terms carefully before accessing or using the MyJansevak platform.
1. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms of Service (“Terms”) along with all associated policies, including:
- Privacy Policy
- Grievance Redressal Policy
- Content & Community Guidelines
- Refund & Cancellation Policy
If you do not agree, you must not use the Platform.
2. Legal Status of Platform (Intermediary)
MyJansevak operates as an intermediary platform under:
- Information Technology Act, 2000 – Section 2(1)(w)
- Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
As an intermediary:
- We host and display third-party content primarily sourced from publicly declared or available public use data.
- We do not initiate or modify user-generated content. (Excluded: Data uploaded by verified profiles)
- We are entitled to safe harbour protection under Section 79 of the IT Act, subject to due diligence.
3. Platform Overview
MyJansevak is a civic-tech platform that:
- Aggregates publicly available data of elected representatives.
- Enables leaders to manage own profile and citizen engagement.
- Provides complaint tracking and communication tools to engage with citizen.
The Platform does not independently verify all content.
4. Political Neutrality & Election Compliance
MyJansevak is a neutral technology platform.
- We do not endorse or support any political party or candidate.
- The Platform does not influence elections in any manner.
- The use of election-influencing messaging, campaign content, or political persuasion through the Platform (including WhatsApp integrations) is strictly prohibited.
Users must comply with:
- Representation of the People Act, 1951
- Election Commission of India guidelines
Violation may result in immediate suspension.
5. Data Collection & Sources
5.1 Leader Data
Non-Verified Profiles:
Collected from:
- Election affidavits (public records)
- Government portals
- Public domain sources
Verified Profiles:
Includes:
- All public data
- Additional data provided by the profile owner
Verification confirms identity and consent only and does not imply endorsement or accuracy.
5.2 Citizen Data
We collect:
- Name
- Mobile number
- Area/location
- Birth Date (optional)
Used for:
- Complaint registration and communication
- Updates related to subscribed leaders
- Platform communication
In certain cases, data may be used for marketing or awareness purposes, subject to consent.
5.3 Local Body Data
Collected from:
- Official government websites
- Public records of local authorities
6. Privacy, Data Protection & User Rights
All data is processed in accordance with:
- Digital Personal Data Protection Act, 2023
User Rights
Leaders and Citizens have the right to:
- Access their personal data
- Request correction
- Request deletion
Data Deletion Requests
Users may request deletion by contacting: support@myjansevak.com
We will:
- Verify identity
- Process requests within reasonable timelines
- Retain data only where required under law
Certain data may be retained for:
- Legal compliance
- Dispute resolution
- Enforcement of agreements
7. User Accounts & Responsibility
Users are responsible for:
- Account security
- All activity under their account
Unauthorized use or impersonation may lead to termination.
8. User-Generated Content & Complaints
- All complaints are user-generated
- Users are solely responsible for submitted content
As per Section 79 of the IT Act:
- MyJansevak is not liable for third-party content if due diligence is followed
We may remove content that:
- Is defamatory (refer: Section 499 of IPC / Bharatiya Nyaya Sanhita equivalent)
- Violates law
- Contains hate speech
9. Grievance Redressal Mechanism
In compliance with: Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
Users may file complaints as per the Grievance Redressal Policy.

10. Third-Party Services
The Platform integrates with:
- ChatSevak (communication service)
- WhatsApp Business API by Meta Platforms
Terms:
- Messaging charges are billed directly by Meta
- Third-party services are governed by their own policies
- MyJansevak is not liable for:
- API failures
- Service downtime
- Account restrictions
11. Paid Services, Refund & Cancellation
Subscription:
Access to premium services requires payment.
Refund Policy:
- As Payments are generally non-refundable
- Refunds may be granted if there is failure of 70% or more of core services
In accordance with: Consumer Protection Act, 2019
Refund decisions are subject to internal evaluation.
12. Intellectual Property
Unique content generated by Team Myjansevak like White papers, Research, Published Data, branding, and technology are owned by Bhagya Media and Marketing, Pune.
Unauthorized use, copying, or scraping is prohibited.
13. Data Retention
Data is retained only as long as necessary and in compliance with applicable law, including:
- Digital Personal Data Protection Act, 2023
14. Limitation of Liability
The Platform is provided on an “as-is” basis.
We are not liable for:
- Indirect or consequential damages
- Political outcomes or reputational impact
As permitted under applicable law.
15. Indemnification
Users agree to indemnify the Company against claims arising from:
- User-generated content
- Misuse of platform
- Legal violations
16. Suspension & Termination
Accounts may be suspended for:
- Policy violations
- Fraud
- Non-payment
17. Force Majeure
We are not liable for failure due to:
- Government restrictions
- Internet shutdowns
- Natural disasters
18. Eligibility
Users must be 18 years or older.
19. Governing Law & Jurisdiction
These Terms are governed by Indian law.
Disputes shall fall under jurisdiction of courts in Pune, Maharashtra.
20. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance.
